ARTI Terms and Conditions
PLEASE READ THE TERMS AND CONDITIONS BELOW AND OUR PRIVACY POLICY for participation in the ARTI Recycling program. USE OF THIS SITE SIGNIFIES YOUR AGREEMENT TO BOTH THE TERMS AND AGREEMENT AND OUR PRIVACY POLICY.
THESE TERMS AND CONDITIONS (THE "CONTRACT") WILL SUPPLEMENT THE TERMS AND CONDITIONS OF ANY APPLICABLE OVERRIDING SIGNED AGREEMENT BETWEEN YOU AND ARTI.
ARTI’S RESPONSIBILITY
- ARTI’S E-waste recycling service GUARANTEES CONSUMERS THAT THEIR ELECTRONICS WASTE WILL NOT BE LANDFILLED. WE WILL RECYCLE OR REFURBISH THEIR PRODUCT. If information destruction option is chosen, the information in the computer will either be completely destroyed or in a NONREADABLE format.
CUSTOMER’S RESPONSIBILITIES:
- If you do not choose the information destruction option, be sure to remove any personal data from your system.
- Pack and ship the products in accordance with ARTI's instructions, including but not limited to instructions regarding weight limitations and types of items to be recycled.
- The packaged products must be available for pickup by the UPS carrier provided by ARTI. Products will not be returned to you.
- You are responsible for the correct packaging of your shipment regardless of whether you purchase a kit or use your own box. IF YOU SEND US A PACKAGE THAT IS OVER THE MAXIMUM WEIGHT PRESCRIBED, WE RESERVE THE RIGHT TO CHARGEBACK YOUR CREDIT CARD FOR ANY ADDITIONAL FEES RESULTING THEREFROM.
- Use sturdy corrugated cardboard boxes. We encourage the use of recycled boxes. Please make sure that the box is in good condition to ship your equipment.
- Wrap fragile materials individually so they do not touch each other.
- Please make sure that the contents in the box are secure and packaged firmly inside. (The total package must not exceed the weight limits prescribed).
- Tape the box closed.
Remove old address/shipping labels from the outside of the box.
- Bring package to shipping or dropoff location.
- If you choose home pickup option, you must wait for our communication before you can place the box outside (your house, apartment or office building). YOU ARE RESPONSIBLE FOR ANY ADDITIONAL FEES DUE TO PICKUP DIFFICULTIES. PLEASE WAIT FOR AND FOLLOW OUR INSTRUCTIONS TO INSURE THAT PICKUP IS SUCCESSFULLY MADE BY UPS. UPS will pick-up the box on the date provided in the email. You do not need to be there to meet the carrier.
- If your package is not available, the carrier will leave you a note and return the next day for pickup. If your package is not available for a second day, the carrier will require you to call and pay for additional pick-ups.
- We will send a label via email or if you order a kit, we will send the shipping label with our kit.
Please ensure that the material shipped is only electronics. No other products or materials will be accepted. Also, the products shipped must match the products described in your order. Off spec products may be returned at your own cost.
CUSTOMER DATA:
- You are responsible for confidential data stored on the products. If you do not choose the information destruction option, you will be responsible for: (a) deleting the data on the hard-disk drives and any other storage devices in the products; (b) backing up or transferring any data prior to deletion; and (c) removing any removable media, such as diskettes, CDs, or PC Cards. ARTI does not accept liability for lost or confidential data or any software.
CONTAMINATED PRODUCTS:
- Products that are or have become contaminated or suspected of being contaminated with chemicals, biological agents or other substances that are not associated with the usual office or household product/environment may not be acceptable for recycling. If these items are not decontaminated prior to shipment, ARTI is not obligated to provide the recycling service to you. In addition, the carrier may refuse shipment and you may incur additional fees. If the product is contaminated, recycling may still be possible. Please call our office at 1-800-Waste54 prior to shipping item. Additional fees may be associated with decontamination.
CANCELLATION POLICY:
- THIS TRANSACTION CANNOT BE CANCELLED FOR ANY REASON. THERE WILL BE NO REFUNDS FOR ANY REASON AND THE PRODUCT CANNOT BE RETURNED TO YOU.
WARRANTY:
- THERE ARE NOT WARRANTIES EXPRESSED OR IMPLIED IN THIS AGREEMENT. ARTI DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITENSS FOR A PARTICULAR PURPOSE.
LIMITATION OF LIABILITY:
- ARTI DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN. ARTI WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT ARTI IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY YOU FOR THE PURCHASE OF SERVICES UNDER THIS AGREEMENT.
